life where does this splitting of the law into the written public law and its underside the unwritten obscene secret code come from from the incomplete let us say in Lacanian terms pas-tout non-all character of the public law explicit public rules are not sufficient so they have to be supplemented by a clandestine unwritten code aimed at those who although they violate no public rules maintain a kind of inner distance and do not truly identify with the so-called spirit of community so this I think is crucial also for the analysis of ideology that the public law law and order that regulates cohesion but precisely as such must not be publicly acknowledged we thus have again the splitting of the field of law into law as in Freudian terms a ich-ideal ego-ideal a symbolic order which regulates social life which maintains social peace and its obscene superego obverse as has been shown by numerous analyses from Mikhail Bakhtin onwards periodic transgressions of the public law are inherent to the social order they function as a condition of social stability I think that the mistake of Bakhtin or rather not of Bakhtin himself as of some of his followers was to present an idealized image of these transgressions while passing in silence over lynching parties gang rapes and so on as the crucial form of the so-called carnivalesque suspension of social hierarchy so again what bothers me at least with some followers of Bakhtin is that is that they only see the so-called liberating effect of this kind of suspension of of social hierarchy etc but I think that precisely the law etc as as if one is doing something truly subversive I think quite on the contrary again each system involves implies a specific form of transgression which is its ultimate let's say force more guilty now that's the other reaction I must have done something I don't know what but it's even worse this is what I'm guilty of so the idea being that this very ignorance of mine it is in very the very ignorance of mine that consists my true guilt I feel guilty precisely because I don't even know what I'm guilty of so my idea is that before yes I'm the subject of power comes this contradictory antagonistic response so what we have here is the entire Lacanian dispositive of the subject split between innocence and abstract a protestation of innocence and an abstract indeterminate guilt when he is confronted with a kind of non-transparent call emanating from the other this call hey you there a call where it is not clear to the subject what the other actually wants
